Alleged detenue Manzoor Ahmed Kharos is produced in custody.
Dr. Sanaullah Abbasi, Deputy Inspector General of Police, Larkana has appeared in person on Court notice and states that D.P.O., Shikarpur has been appointed as enquiry officer to look into the matter. He further states that more senior officers will also be joined in conducting the enquiry and report will be submitted soon. One of the alleged detenues, namely, Manzoor Ahmed and learned Counsel for the petitioner state that he (Manzoor Ahmed), who is nominated in various cases, has been severely tortured and he is unable to walk. Under the circumstances, when position was explained to police officers by the learned Asst. A. G., they produced the remand order, dated 7.7.2009, under Section 167, Cr.P.C, wherein two days’ police custody with direction to S.I.O to produce the accused before medical officer at Civil Hospital, Lakhi Ghulam Shah, for treatment and for medical certificate and I.O. was also directed by the learned Civil Judge & J.M., Lakhi Ghulam Shah to submit the report within time before the said Court. Under the circumstances, we are not inclined to pass any such order and it may be observed that the order passed by the Civil Judge & J. M., Lakhi Ghulam Shah be complied with in letter and spirit. Since, detenue Manzoor Ahmed has been produced in Court and list of cases has been filed, now the petitioner may approach the competent Courts of law for taking appropriate remedy in accordance with law.
So far detenue Shabir Ahmed Channa is concerned, the police officials present in Court state that he has not been arrested again as alleged by the petitioner. Under the circumstances, the advocate for the petitioner or the petitioner may file proper application to concerned police station for registration of case of Shabir Ahmed Channa as a missing person and the police may take action in accordance with law.
Petition stands disposed of in above terms. The D.I.G. Police, Larkana is required to submit the enquiry report to Additional Registrar of this Court for perusal.
