A compromise application has been filed, both the learned counsel present in the Court for the appellants & Respondent No.10 (a) submit that they have settled their disputes and there is no outstanding dispute between them anymore. They have also undertaken that they would not press any dispute as to title, interest, ownership and possession of the suit land as settled under the compromise dated 09-08-2010. Learned counsel appearing on behalf of the appellants submit that he is giving two Demand Drafts bearing No.0413637 and No.0413638 amounting to Rs.10,00,000/- and Rs.15,00,000/- dated 02-12-2010 respectively to the Respondent No.10 (a) in the Court today and the Respondent No.10(a) in turn has returned the post dated cheque bearing No.8701334 dated 06-12-2010 amounting to Rs.25,00000/- to them in the Court today. Learned counsel for the appellants also submits that in view of the compromise, the appellants do not wish to press this Miscellaneous Civil Appeal No.18 of 1995 any further and has now no grievance either against Respondent No.10 (a), who according to him is the main party to the suit, or other Respondents.
In view of the specific request made by the appellants and duly endorsed and affirmed by the counsel for the Respondents, this compromise application is allowed, subject to the condition that no government interest, if any, should either be vitiated, hampered or affected in this regard.
Mr. Allah Bachayo Soomro, learned Additional A.G Sindh who represents the Respondent Government agencies has also endorsed his no objection to the said compromise.
In view of the observations made supra, this Miscellaneous Civil Appeal is disposed of in the above terms along with the listed and pending application(s), if any.
